Hi, after regular mibehavoir and absenteesm, my subordinate is given a suspension letter with charge sheet. Earlier he complained about harrashment by organuzation. Now will there be any problem for me? Due to his false allegations, our management is looking at me with doubt and threatening me to look for a new job. He mailed about the issue to all members of the organization.This has created a very bad image of me in whole organization. I m committed and do not want to leave. The matter is under enquiry now. If i get the new job , can they relieve me with legally or they have to hold my relieving letter in view of on going enquiry?

Dear Vishal,

Your situation is like the hunter being hunted. His allegations against you turned the management doubtful about your effective role as an immediate superior and their signal to you for finding out an alternative employment elsewhere mean that out of your personal grudge against the particular subordinate, you are in the habit of complaining about him on flimsy grounds and instrumental for the disciplinary proceedings against him or though your subordinate he is an influential employee than you and successfully turned the tables against you. Your post indicates the desire of both your management and yourself to part ways. Find a better job. In the mean time try to convince the Enquiry Officer that you didn't have any personal issues with the subordinate and your complaint against him was simply based on the requirement for maintaining proper behaviour and avoidence of absenteeism in the interest of the organization only and do not try to antagonize the individual by advancing further allegations against him. Since the decision for suspension and disciplinary action would not have been taken by you single-handedly, you need not bother about it unnecessarily by blowing things out of proportion.

Did you actually harass him?
If you are asked about the allegations(you will be),defend yourself politely and point to point attention.
More sensational the allegation,more the fuss.
Allegations are always made to defend and divert.
When I read your post,I get the impression that management itself may not be too happy with you.
One disgruntled man cannot create bad impression about you.
You need to reassess your "commitment" to the company as it is not reciprocal.
Company is not well disposed of to you is my reading that one allegation and they have doubt on you and that too from a man the company has suspended.
Take advice from a lawyer and clear your name and exit for better chances.

Company may not like to receive you during enquiry.
Company can always shelve the enquiry and allow you to leave,but think why your complaint against the other employee has not been the main focus.
Whenever any complaint is made,the response is often a counter complaint.
Face the enquiry-clear yourself and quit.
The hunter is now the prey.
Analyse why the tables have turned.
In final analysis,the company is not suitable for you anymore.
