I am Siva and I work for a private sector and in offer it was specified that if employee want to leave organization, 2 months notice is compulsory.
now im on floor and i have resigned for my job and the notice i gave is 2 weeks.
could anybody help me in following regard,
1) what will be the compensation i have to pay towards my employer?
2) is it total one month salary i have to pay ?
3) only basic for two months i have to pay?
4) how i need to handle the situation.
5) is it compulsory that i have to pay compensation even if i was on bench
6) what are the policies that comes under labour act for employee exit with short notice
7) are there any common policies falls under labour act that every company need to follows

Here are your answers:

Ref:Standing Orders of the organisation & agreement you have sighned at the time of your joining.

Please go through the standing orders of your organisation in which the policies regarding separation of the employee will be mentioned.

Suppose if the Org policie states that compensation need to be Paid.Than it will be subjected to your bargaining & persuasion with the management.

5) is it compulsory that i have to pay compensation even if i was on bench

thanks, i have gone thru my order and it was clearly stated as,
After confirmation of your employement. either party can terminate this employement by serving a notice of 2 months on the other, save and except that the company at its option, can pay salary in lieu o the notice period.
Here is the confusion,
-- it was not clearly specified that which salary need to be compensated
is it BASIC, GROSS or NET
-- what is the meaning of, "on the other, save and except that the company as its option".
-- can i ask management

Salary means your gross earning that appears in your salary sheet every month. you will ahev to pay them back 6 week salary that you would have drawed had to had worked with them.
Also, on compassionate ground, some companies adjust the dues against your receivables with them.
