One of my HR friend is working in a Manufacturing Company in Bangalore. He was reporting to HR Manager who was doing all kind of fraud in that Company. That HR Manager used to take commission from Vendors and service providers. My friend is working as Senior HR Officer and reported about his Manager's illegal activities to MD and VP. As a result, his HR Manager was terminated on the spot as it was against the Company ethics.
Later my friend got a good offer as a HR Manager in other Company. He decided to discuss his resignation with VP. But because of his performance and good work, VP promised him with a good increment and promotion in his next appraisal and requested him to stay back. My friend trusted his VP's words and withdrew his resignation and decided to stay there.
Management hired a new HR Manager and my friend was made to report to him. From the day one, the New Manager tried to create problems in my friend's work and always complained that he is not satisfied with his reporting. Later after 3 months, one day the New HR Manager forced my friend to resign from his job. When my surprised struck friend refused to do so, he gave him a Termination letter stating non performance and non reporting as reasons for termination.No warning letter was given to my friend regarding his non performance by his Manager in last 3 months. When my friend asked the evidence of his non performance, the new HR Manager was not able to give a single incidence which proved his non performance.The Manager has planned my friend's termination when MD was out of station for a week so that my friend cannot meet MD on this issue. When my friend approached VP, vp told that he cannot do anything for him in this matter. Remember 2 months back, VP was the person who retained my friend because of his good performance and now he is telling a different story.
My friend wrote a mail to MD about the injustice happened to him. He was called to discuss, but again his New Manager has cooked up a different story that my friend has forged his signature in some documents. But this was never discussed earlier at the time of termination.My friend was greatly depressed as his Manager is ruining his career and he is not giving him opportunity to prove his innocence. My friend has solid proof of his performance and reporting structure which he can prove if at all he is given a chance to meet MD in person.
Later my friend came to know that the master mind behind his termination was his EX HR Manager who is a very close friend of his New Manager. But officially my friend cannot prove this to Management.
All he wants to get a graceful exit from that Company. If he resigns, then it means that he has done forgery and he has accepted his non performance. He is ready to fight against his Non professional Manager at the cost of his career.
I request all to suggest a way for my friend to sustain his career as he has become a victom for raising his voice against his EX Manager.

The case what you have presented makes a sad reading. However such unscrupulous persons do exist and it is not surprising. As per your narration your friend has knocked all doors in vain. May be the fraud is being done at a much higher level and that could be a reason why the seniors are silent on the issue.
Your friend may attempt one more trial by writing to all the seniors stating the facts. This could be one last action before calling it a day and looking for a job elsewhere. Continuing in the same company is futile,considering the many unpleasant developments that have already taken place.

Your friend's Story is very unfortunate. And As you say If he has the proof for his innocence then he can even go for Legal action if he is mentally and financially ready for the same.
But , one thing I should tell ,that if your friend is from H.R. Filed then , he can directly join this forum and describe the facts in his words clearly and if possible can discuss with some of the experts directly.
So,Please tell him to directly join and describe the matter. Here any experts can give direct assistance to him on this.
AND FOR those 2 HR Managers, IF you are reading this and if you are the real culprits; then please leave this HR field .This Filed is not for people like you.

Thanks for your prompt reply. Shortly my friend will join this group and post the complete story. He too has decided to file a legal case against his New HR Manager for his illegal termination.

The story shows the inadequate experience in handling the bribe / illegal matters and other crook politics.
When something is suspicious on his superior, he should not go directly and complain the matter to the management. He should prepare a plan to make him to be caught by the management directly.
Management might felt that, even though he was demanding / getting commissions from vendors, he was able to manage the show at his work. But just because an employee have complained about him with proofs, they were forced to take this action.
If he would have caught by the management directly, they would have left him with severe warning.
Management must have assessed that, you could not handle that HR Manager position alone. The maturity you have shown in the previous issue was not acceptable to give promotion. That might be the reason for bringing the new HR manager.
The same happens in Govt organizations. If you complain a bribe issue to anti corruption bureau and if they arrest that govt official and sacks him, you will be getting that particular work done so fast. But when you approach next time with new work, you would be treated very badly with new official in that seat. They will make you to feel sorry for the last incident.
Fighting against corruption requires patience and proper plan. Otherwise you would be fixed and left alone. Try to live with them and the plan you initiate should make them to be caught by themselves.
It is nice to see a bold guy. But need an experience in handling things. You will learn it. My advice is that, get a 3 months extension from your MD and search for other job and leave. Start a fresh life.

Matter to be dealt with careful keeping their future safe. One more thing want to say Tit for Tat. There is no meaning in fighting with the top management against his own boss. Ultimately, your friend should survive. Option is either to compromise with the situation or leave the organization with good will.

To add what others said, Having travelled thus far, May be your friend can describe the complete story and post them to the personal names of all his Board of Directors if he can have their addresses. Should not delay, go for filing petition in appropriate court/Labour Dept. if prepared to fight it out tooth & nail before the culprits wake up. Ensure that he/she should be armed with supportive documentary evidences to justify his/her previous good performances and instances in what the previous HR Manager was exposed and terminated.
