Dear seniors,

My query:

Is there any gazette passed during a year regarding public and national holidays for private sectors? Or is anything mentioned for the same in any books?

Kindly reply.

Kindly see the Model Standing Order which specifies the Holidays in Private Sector. Please also check the standing order applicable to your state. If it's a shop or establishment, then go through the Shop and Establishment Act.

Dear Himanshu Saraiya,

Irrespective of the sectoral classification to which it belongs, an industrial establishment has to grant a specified number of national and festival holidays to its employees as provided in the State National and Festival Holidays Act applicable to it. Public holidays are the holidays comprising national and various festival holidays as declared by the Central and State Governments every year to their respective offices/establishments.

Insofar as industrial establishments are concerned, it is mandatory to grant those two types of holidays to their employees every year. Of course, choice is given in the respective State's Act to fix and specify a certain number of festival holidays and get them approved under the Act within a certain time limit either from the date of commencement of the establishment or the date of application of the Act. Therefore, please refer to your State Act.

As per the State National & Festival Holiday Act, a minimum of 5 days of compulsory holidays should be declared. These include Republic Day, Independence Day, Labor Day, Gandhi Jayanthi, and State Rajyotsava Day. After these 5 days, it is left to the management of the company to declare optional holidays on festivals.

Umakanthan Sir,

Thank you for your reply. I belong to Gujarat state, and in the Gujarat Factories Act, there is no mention of national, public, and festival holidays. Therefore, I would like to understand where the definitions of national holidays, public holidays, and festival holidays can be found.

Thank you
