We are a civil engineering company and we employ contract labor for specialized work such as geotechnical investigation and site excavation. Since the nature of the job is specialized, their per day rate is well above Rs. 800 per day, and their work might be for a few days in a month or for 1-2 months depending upon the nature of the work.
In this case, is PF Form 11 to be filled by such contract labor whose charges are well above the PF limit? kindly revert. I repeat, these are not our employees but just contract labor.

Compliance of any statutory requirements by the subcontractors, the principal contractor will be held responsible (in case of any lapse) by the contractor. As the principal contractor, you need to ensure the contractor complies as per the notification and provides you with the photocopy of the acknowledgment. Monitoring of the statutory compliance by the subcontractors belongs to the principal employer.

The Contract Labour Act makes it very clear that you are responsible for the PF compliance of all contract employees working for you. Since these contract employees have a higher salary on the date of joining, they have the option to claim exemption. The option is exercised by filling out Form 11 and submitting it to their employer (not to you). However, to ensure compliance, it's good to have a copy in your file.
