Hi, I left an orginization 2years back and they say that I am liable to pay them Rs. 5000 approx, however I don't wish to pay that amount as I do not find it feasible, the company has not yet given my F&F and I wish to withdraw my P.F amount.
Please suggest if there is a way out where Im not supposed to pay that amount to the company and get my P.F and in this situation how many days will it take to get the P.F?

There have been few friends who suggested to go to the P.F office fill a general P.F form and give a govt banks account# and my P.F will be transferred. I would like to confirm if this is one of the options and does it really work without getting the employer involved?

Hey Hi, No one can take your PF Amount at any cost u are eligible to ur PF Amount..If u have not given ur Notice Period also. Ayesha

The form 10c and 19 to be submit by you to PF office, has to go to the employer for filling up of the details of every month-wise deduction. The employer holds the key there. But they can not hold on for more than 15 days.
They can provide the wrong details and make delay in the process of withdraw. Even they can add that since you have not completed the terms and condition, that will be a added advantage to them.
But the employer can not block you from withdraw. You have submit the letter to PF commissioner, stating that due to some personal reasons you were unable to complete the service and you are need of money now so i am withdrawing.
This is more than enough. You have to attach a signed cancelled cheque along with the form so that the amount can be transferred to that account.

Dear friend,
Your company's view is right if there is a clause in your appointment order /contract signed by you at the time of joining with the company,about the NOTICE PERIOD.
The company cannot say to forward the pf claim for this reason but they can hold your service certificate and relieving order issuance.(since it may affect your future service, you settle the amount and avail the relieving order and certificae - if there is any clause as said above.)
You can transfer the pf accumulations by submitting Form 13 to the present employer.
INCASE, YOU WANT TO WITHDRAW YOUR PF ACCUMULATIONS WITHOUT THE INTERVENTION OF YOUR PREVIOUS EMPLOYER,
step.1:You can download withdrawal form in Form 19 and 10C , NSSN FORM from the website EPFO.
step2: you can fillup all the details about yourself and fill the bank account coloumn with your savings bank account.
step3:you can enclose the first page of Pass Book of your Bank account.
step4:you send the complete set of forms with enclosures to the previous employer for forwarding the forms to pf office
step5.You can obtain attestation in the column of attestation of employer/authorised person :: (if you want to send the claim straight to pf office) from the bank manager with which you are having savings bank account
step6:you can send the set of forms to the PF office in which your previous employer have accounts - by registered post.
YOU WILL GET YOUR MONEY INTO YOUR BANK ACCOUNT WITHIN 45 DAYS
But normally, it is advisable to settle the same through previous employer.
