I request you all to help me and clear my doubts as soon as possible.
If an employee (basic salary greater than 10,000) resigns and serves proper notice period whether he is eligible for bonus ( Diwali Bonus is part of the C.T.C) ?

Yes an employee is eligible for Diwali bonus, if not complete, at least on pro rata basis an employee should get Diwali Bonus

By our bonus is not covered by payment of bonus act. So it’s discretionary It’s at the wish of the company whether to give it to you or not.

Dear Saswata Bannerjee,
Every employer in India should pay bonus to employees whose basic is less than Rs. 10,000/- .
Please tell me how the bonus of your company or any company operating in India is not covered by the Payment of Bonus Act .

If you read the original post, it very clearly states the concerned person has basic above ₹10000
So, since bonus under payment of bonus act applies only to employees with salary below ₹10000, the act does not apply and the bonus is payable at the discretion of employer.
