Paying good service award or attendance bonus kinds of incentives to contract workers directly by the principal employer can become harmful to him because these acts of principal employer can lead to make the contract sham. But at the same time, in recognition of the performance if the contractor is paying some amount/ performance pay which he gets reimbursed from the principal employer, the same may become genuine one. Moreover, any payment made directly by the principal employer or the interference of principal employer in the wage negotiation of the contract workers would make the contract sham. Once the contract is proved to be sham, the workers can claim regularisation.
