Just want some clarification on PF rules and applicability.
1. A company having more than 20 employees has to compulsoryly get a PF number but if the employees basic salary is more than 8100.
is it compulsory for the company to pay PF in this case or is it upto the company not to pay PF?
2. If an employee who is new joinee was getting PF deducted with his old employer, what are the rules on joining his new company if the company does not pay PF.
pls advise.

I. In case of already PF member, even though, he crosses his salary from Rs.6500/-, you have to continue his membership restricting his salary to Rs.6500 for PF purpose.(Compulsory).
2.In case of new employee who is a PF member and joined in your organization, you have to follow the same procedure (compulsory).
If his salary is beyond Rs.6500 and if he insists not to deduct PF, you have to continue him as PF member.

1) if employee is having Basic+DA = more thn 6500 PF deduction is not mandatory but if employee is PF member in past(same company) and now Basic+DA is 6500+ in that case PF deduction is complusary.
2) If employee is new joinee and was PF member(Past company) and s/he has withdrawal PF balance and dont want to deduct PF(if Basic+DA=6500+) in that situation you may ask to fill Form 11(self declaration form).

Please make contributions to EPFO for all members, as if their salary is Rs.6500/-. It is voluntary on the part of
employer for making contributions above Rs.6500/- salary. But the same is not mandatory.
Now, as per earlier reports appeared in Newspaper and also as per announcement made by Minister of State in
Union Labour Ministry,PF salary ceiling is being raised from 6500/- to Rs.15000/- with effect from 01/04/14.
For new employees also, you have to cover them with PF.
