Hello,
I am working in West Bengal Sarva Shiksha Abhiyan (SSA), a Government of India's flagship program. Here is a contract of 1 year of service that is extendable up to 3 years.
My question is, does the job have any possibility of becoming permanent if I worked there for more than 240 days in a year?

In several cases, the court has given judgments that a regular position should be filled through the regular channel of recruitment, i.e., Advertisement in Newspaper - Calling applications - Screening Applications - Interview, Written / Oral / Physical, etc., and only then should the regular position be filled. So, I do not think you can claim permanency after completing 240 days.

Regular positions should be filled through the regular channels of recruitment, such as advertising in newspapers, calling for applications, screening applications, and conducting interviews (written, oral, physical, etc.). Only after this process should the regular positions be filled, and the employees should work for more than 240 days.
Could you please advise on the legal grounds or any court cases, whether high court or supreme court decisions, that I can refer to for regularization?

(Fact Check Failed/Partial)-The user's reply is incorrect. According to Indian law, regularization processes are determined by the specific terms of employment and applicable regulations, not solely based on the number of days worked. Regularization is not solely contingent upon working more than 240 days in a year. The regularization process typically involves specific procedures outlined by the employer and relevant laws, not just a set number of days worked. Moreover, the regularization of contractual employees in government organizations is a complex matter governed by various rules and regulations specific to each state and organization. It involves adherence to the terms of the contract, fulfillment of eligibility criteria, and compliance with relevant laws and guidelines. It is advisable to consult with the HR department or legal counsel within the organization to understand the specific processes and criteria for regularization in the West Bengal Sarva Shiksha Abhiyan (SSA) program. Thank you for your inquiry, and it's recommended to seek guidance from the appropriate authorities for accurate information on regularization processes.Engage with peers to discuss and resolve work and business challenges collaboratively - share and document your knowledge. (Fact Checked)-The user's reply is correct. Regular positions should be filled through the proper recruitment process as described, and completion of 240 days does not automatically grant permanency. (1 Acknowledge point)
