Just joined,, Well would like to know the exact rule for registering PF and ESI
for exp: Minimum no of employees :
Minimum salary employee draws:
If salary is above 15K or 20K will PF applicable

Dear Shabeer, as per EPF ACT PF rule is : PF wages ( Basic +Da+ Food allw.) = 6500/PM as per ESIC Act : gross wages upto 15000/PM

For PF registration,if no. of employees are 20 or more, in such cases, Applicability is statutorily automatically,
If less than 20 employees, one can get registration voluntarily under section 1(4),
If the estt. is already a unit of a covered estt., it is automatically covered under section 2-A.- irrespective of no. of employees.
For salary-- wages - upto Rs.6500 for new entrants-compulsary,
For already members of EPF - no limit if getting benefit upto the current wage,otherwise as per consent of both upto certain limit beyond 6500.
For ESI- no. of employees required is 10, Salary- 15000 but only if the estt is situated in the notified area.

I would like to know the information about following point
Person is Retired / Resigned form the establishment. He withdrawn his PF and also getting pension or might have withdrawn entire pension.
Even Ex-servicemen who have retired, recd. their PF and getting Pension. Now If he joins with any new establishment and drawing Salary [Bssic+Da+food ] more than Rs.6500/- or say over and above prescribed limit, and his age is above 58 years.
Under the circumstances , whether He is entitled PF benefit with New Establishment. If not what document / certification is required to be obtained from such person by New Establishment or only form No.11 suffices the purpose? Under which section and rules we will get this information?

As per provisions, a person above 58 years of age,if employed, need not to be made a member of EPS at all. However in case if the employer and the employee both agree, he can be allowed to contribute under EPF Scheme 1952 at mutually agreed salary and rate of contribution provided employer agrees to pay Administrative Charges and RPFC accepts the same.
