The amendment to Karnataka Industrial Establishment (National and Festival Holidays) Act, 1963 has come into force with effect from September, 30, 1997.
Accordingly, the Labour Commissioner has directed that all industries, commercial establishment, plantations and others to whom the Act applies to compulsorily declare 10 paid holidays in a year.
Of these 10 paid holidays the following are compulsory: Republic Day, Independence Day, Gandhi Jayanthi, May Day and Kannada Rajyotsava. The remaining five are to be decided after a mutual agreement is arrived at between the employer and the employees.
Hitherto approval of the Labour Department was necessary before the holidays could be declared. With the amendment such approval is not required. Employers and employees may approach the department only in case of a dispute.
The number of National & Festival Holidays stands increased from Nine to Ten.
Rajyotsava day is mandatory and should be declared compulsorily with the other four National Holidays
It is also advised that a mere intimation to the Labour department would ensure complete compliance under the Act.
