Hello Everyone.
I have a query related to the leaves . We have a lady employee who is on maternity leave and still didnt join the duties yet after the delivery. Every quarter we add leave bal to all employees in the organisation. My question is do we need to credit the leave balance to her during maternity break or it has to be credited at once she join the duties.
Pls guide me to go further.

In my view, you can credit the leave during her maternity leave to her account a sin the case of any other regular employee since she is deemed to be in employment even during her maternity leave.However if your question is whether she earns leave for the period she is on maternity leave,then the reply is that she does not earn any leave for the period during which she is on maternity leave.

Ok so it means that the number of days she is on maternity leave for those many days leave balance should be credited once female employee reports back to the work. Is that right

As Saikuamr said, during the maternity leave period, the employee does not earn leave. Therefore, it is advisable not to give leave. Suppose, if she has been an ESI covered employee, then ESI will be giving her maternity leave. In such a scenario, she will not be paid by the company and will be marked as ESI leave which will not be counted for earning leave in the subsequent period just because an employee earns leave only for the days he is physically present. In another case, suppose that a male employee has taken leave for three months on medical ground. Do you give the same EL to that employee? I believe you will not. Also remember that privileges become right and you should be very careful while extending any privileges because once it has become a practice you cannot take it back!!
