Dear All,
I am working with a reputed company. The problem is that I have resigned from my job. than I was not the confirmed employee of the organization and my notice period was only for one month. But next day after my resign I have received my job confirmation mail and I was told by my senior that now I have to serve for 3 months.
Please guide me that in this situation what is my notice period will be. Before resign I did not have information about my job confirmation i.e. either I am confirmed employee or not.
Thanks.

Dear Shri. Arun C. Kumar
What I suggest you to write back your employer. Just write them that you have already resigned and after your resignation, your services were confirmed. You can explain that, the terms of service as they stood at the time of your resignation, will further continue and not the revised terms of service. Hence, you inform them that, the resignation given by you by giving a month's notice-in advance is valid and proper. And request them to relieve you accordingly.
This will help.

Well, the first you have resigned when you were on probation then you don't need to serve any notice period if such is mentioned in the employment letter.
However, being a professional you can consult with HR regarding and finish the assigned projects at some level and hand over the docs and credential and then you can leave.

Dear Sh. Arun Kumar,
The company Mgt may've misconstrued the reason of ur resignation citing delay in confirmation & they wud've confimed u hurriely soon after ur resignation. In this case u must talk to the concern in HR & get the matter clarified.
If this is not the case then suggestion of preceding member best suits in given present situation.

Hi Arun,
Please clarify the below points.
How long is the probation period in your organization according to the policy?
Have you completed your probation period?
Was your resignation acknowledged by HR/Immediate supervisor?
Which team is the "Senior" whom you have mentioned in your query?
In general, you shall approach the HR department and clarify this issue. You need to also ensure that your are not tied up in any projects/delivery. Rest can be suggested, once you comment to the required information.

Dear Arun,
You cannot be considered confirmed unless you have accepted in written the confirmation letter issued by your management. However, if you have decided to resign and get relieved you must also have an acknowledgement of your Resignation in written by your HOD and HR Dept.

Dear Arun,
Keep your cool, speak to your immediate boss, even if he does not talk to you properly. In my opinion do not try to talk legal terms now (Probation period - 1 month notice at the time of resignation etc.,). Politely explain to him that you have given an assurance to your prospective employer that you will join within a month based on your offer of employment and he may not hold the offer any further.
I am not sure from your communication, as to whether you have communicated the matter to your prospective employer,
My suggestion is if you have not done so, do it now. Explain him that you expected to get relieved upon serving the notice period of 30 days as mentioned in your offer of employment. Also tell him that your intention is to join him but you intend to complete the transition process smoothly without causing discomfort to your present employer. Give him the assurance that you will definitely join him and state that you neither have alternate offers nor have intentions to negotiate with your present employer based on your new offer.
Any employer will appreciate when a candidate is keen on a smooth transition process.
Trust this will bring about a solution.
