My appointment date is March 1, 2012, and my dismissal date is July 31, 2013. I did not receive any benefits such as increment payment, medical allowance, leave salary, releasing certificate, and experience certificate. I have only received my monthly payment. Could you please provide clarification on this matter and explain the relevant rules?

Well, you can ask for the relieving as well as experience certificate from them. In case they deny, you must have the appointment letter and the termination letter mentioning the date, along with the bank statements showing where the salary gets credited. This documentation can be shown to the new employer to demonstrate your work experience and the last salary drawn. Specify to the new employer that you were dismissed for reason XYZ.

Notwithstanding the background and the reasons for your dismissal, nobody would suggest you go through the relevant rules of your state. Please understand that no company/management, however bad they may be, would simply issue a dismissal unless they have solid reasons to do so. Instead of taking the legal route or abiding by rules and regulations, the best course of action is to consider returning to your previous company and discussing with HR/management. Show sincerity in your approach and express remorse for the circumstances that led to your dismissal.

If you have been truthful and honest in your work with an unblemished record, then consider sending a registered letter in consultation with a lawyer. The outcome may depend on the duration of your employment and your position within the company.

Generally, an employee is dismissed from service on account of misconduct. In such a case, the employer ceases all the benefits of the employee except the salary due to him. When issuing the Dismissal Notice/letter, the cause of dismissal and effective date are mentioned, and no relieving letter is separately given. Even the experience letter is given on request, the cause of dismissal will be mentioned, and having such certificates will not be useful. However, the employer can be requested for the Service Certificate as advised by Couvery, a contributing member.

Dear Member,

You have very calmly mentioned that you have been dismissed from the service without mentioning the reasons thereof. You are not entitled to any monetary benefits other than the monthly salary. The management has taken the right action in disallowing the monetary benefits.

As for your claim for a releasing certificate and experience certificate, I agree with Eswararao Ivaturi that even if the experience letter and relieving certificate mention dismissal, it may do more harm than good. The only option left for you is to approach the management (HR Dept) and humbly request them to issue the experience letter and relieving certificate without mentioning the reasons for your dismissal.

Even if they refuse to issue such experience letter and relieving certificate, you have nothing to lose because the maximum damage has already been done by them. My sympathy is with you.

Dear Member,

No one can hold your relieving certificate and experience certificate if you have no issues pending at the organization. However, in most cases, terminations result from not meeting management's expectations. Sometimes, this occurs because you have not delivered results as per your Key Result Areas (KRAs).

Most HR professionals do not want to give you a hard time when you leave the organization, but you should express your views with courtesy towards HR.
