Dear Seniors,
If an Employer doesn't sign on the PF Forms, what will be the action taken from Employee who ha s left the Organozation for last 01 year and want hios PF amount.
Kindly advise.

Dear Prasantsaroj
You can withdraw your PF even though the employer do not attest your form.
Your employer has no authority to held ur pf or stop it. It is maintained with the PF office, a govt. body and your employer has not control over it.
However before appliying for the PF make sure of 2 things
You must have your PF code number with you & Second one is, employer has deposited your PF with the Department and has filed necessary return with the office.
Now, just fill in the withdrawl form (10c and 19) and get it attested from your Bank Manager.
You can deposit this form at your regional PF office where your account has been kept.

In my opinion, if employer fails to attest and send the filled up forms to RPFC within 5 days failing which , employer can be prosecuted.
Employee may get the form attested from any of the prescribed authority and send to RPFC with the request to either settle it or get it attested through his Enf. Officer and settle it.
If joined in new estt., may get the account transferred in new estt. Through HR .
