Dear Tushar,
According to the "MICRO, SMALL AND MEDIUM ENTERPRISES DEVELOPMENT ACT, 2006" under sub-section (1) of section 7, a Micro Enterprise is where the investment in plant and machinery does not exceed twenty-five lakh rupees. A Small Enterprise is where the investment in plant and machinery is more than twenty-five lakh rupees but does not exceed five crore rupees. Lastly, a Medium Enterprise is where the investment in plant and machinery is more than five crore rupees but does not exceed ten crore rupees.

I have a further question on this matter. The Act mentions: "Small Enterprise is where the investment in plant and machinery is more than twenty-five lakh rupees but does not exceed five crore rupees". My question is, is this limit of 5 crores for one factory or all factories run under a company name? There is a lot of confusion where some people say this limit is for factories within a district, while others say this limit is factory-wise. Please, can you guide on this.

Act does not specify the pattern of investment. It only specifies investment in plant and machinery. Based on your input, I believe that your company has different units under one name. Hence, the total investment will be considered for the applicability of subsection 1 of Section 7 under the MSMED Act 2006.

This query is related to hospital administration. I want to prepare a letter for a person who has assisted many doctors in operating on patients. He wants a letter from his current hospital highlighting his excellence and certification from doctors. Kindly help.

True, the Act is not very clear on the pattern of investment. Is this the general practice to consider the total investment in the plant & machinery for the company as a whole, even though it has factories located in different states with less than 5 crores investment (for small enterprises)? The factories are under the same name (i.e., company name).

Dear preetyka_78,
I endorse your view that the Act is not very clear (similar to other laws). I would like to add that, in my opinion, our lawmaking machinery intentionally keeps us in ambiguity to ensure that many continue to benefit. This ambiguity is a root cause of corruption in India. Laws are often vague and impractical, making it challenging for citizens to comply. Even if thousands follow the path shown by figures like Anna Hazare, corruption persists and even multiplies. Unfortunately, some argue that due to Anna's efforts, corruption has increased. I agree with this perspective, while maintaining respect for Anna. Today, officers instruct us to adhere strictly to the law.
(Sorry Anna ji for addressing you as Anna.)
Thank you.

Hi All,
I would like to share more on this. The government-authorized persons who act must calculate the profit for themselves rather than for the government, making them pre-corrupted. As a result, the general public has to bear everything.
Please correct me if I am wrong anywhere.
