Dear Anshu,
Medical bonus is not specifically defined under Maternity Benefit Act, 1961 but keeping in view section 8 of this Act it may be stated to the amount paid to the eligible woman employee if no pre-natal confinement & post – natal care is provided by the employer free of charge. At this point of time we are required to pay a sum of Rs. 3500/- as medical bonus along with 2nd installment of the maternity benefit.
Opinion submitted as per MB Act, 1961 & Haryana Maternity Benefit Rules, 1967.

Dear Sir,
Thanks for your reply. what is the meaning of "if no pre-natal confinement & post – natal care is provided by the employer free of charge.". In my previous company employee who went on maternity leave used to get Rs. 1000/- as medical bonus which is not happening in my current company. Is there any legal issue involved on not giving medical bonus.

Dear Anshu,

In the beginning, this amount of medical bonus was Rs. 250/- and thereafter it was enhanced time and again by the Govt. Before August 2011, it was Rs. 1000/-. As far as the involvement of legal issues is concerned, it is clarified that it is a violation of one of the provisions of this Act (section 8).

Could you please differentiate the way a woman employee who is covered under ESI is given maternity benefits from one who has a corporate mediclaim policy and is not covered by ESI.
