Dear All, Please tell me the leave policy in haryana state under Shop & Establishment Act and under Factories Act. Please help me at earliest. Looking for your assistance.. Thanks Anisha

Dear Anisha,

A number of leave policies have been provided by the members which can be considered for preparing leave policy for your unit keeping in view the applicable laws prevailing in Haryana.As asked by you both the enactments will not be applicable at a time. If your establishment is covered under the Factories Act, 1948 then the Punjab Shops & Commercial Establishment Act, 1958 as applicable to the state of Haryana will not be applicable & therefore, first see which of the Act is applicable in you case & then go through the leave provisions in that Act while finalizing the policy.If your establishment is covered under Shops Act then go through section 14 of Punjab Shops Act regarding different types of leaves. If the unit is covered under Factories Act, 1948 then first go through chapter VIII on annual leave with wages for making policy on grant & accumulation of EL & for providing CL & SL you should go through the Punjab Industrial Establishment ( National & Festival Holidays and Casual & Sick Leaves) Act, 1965. Also go through the Maternity Benefit Act, 1961 for making provisions on grant of minimum statutory maternity leaves( benefit).

1 Is it Compulsory to give leave encashment under section 16/17 or section 24/ 25 of the Punjab Shops & Establishments Act, 1958 for Punjab and Haryana on separation of employment.
2 Currently we have discontinued leave encashment for the leave accumulated w.e.f. 1st April, 2016 on separation. i.e. leave encashment is allowed for the leaves accumulation till 31st March, 2016 only and it is not applicable for the leave accumulated from 1st April, 2016, by employees
