i want to know when the salary is increased in the month of apr 12 to Rs. 15000 and above but effective month is May 12 and the same is paid with Apr 12 arears , upto what month we should deduct the ESIC amt and what the amt would be deducted as esic amt , our consaltant is saying the amt should be deducted upt o oct 12 , as per my knowledge we shoud stop the dection for the salary 15000 and above as they are comming under mediclaim policy. Pl update me with the rules for the same .
Pl reply on my mail id on urgent basis as i require this information urgently.

Hi Janhavi,
As per the ESIC Act, contribution periods are from Apr-Sep and Oct-Mar. In case contributions are made for any employee during 1 month also in any contribution period, the same needs to be continued till the end of the contribution period. No provision exists to exclude as per the wishes of the employers.
In the case mentioned above, contributions needs to be paid for wages of Sep12 on the increased gross amount only and not the previous one. Commencing from Oct 12 wages, the employee can be excluded from the provisions of ESI.
