Dear all,

I have a doubt regarding the stability certificate from a competent person under Rule 3c of the Rajasthan Factories Rules 1951. We have a hazardous waste management facility in western Rajasthan near Jodhpur. The nature of the work involves industrial waste collection, treatment, and disposal into a landfill. There is no manufacturing process; it is essentially a service sector.

My doubt pertains to the fact that we have obtained permission for a total of 17 drawings, including all aspects such as the landfill, rainwater collection sumps, security gates, compound wall, and master plan. The landfill and some of the sumps are constructed with HDPE sheets placed on the ground with some depression.

The factory inspector is advising us to obtain a certificate for all drawings by conducting tests through a competent agency that is authorized. They have quoted a price of 4000 per drawing.

Can someone please confirm whether the stability test is required only for buildings or for all plans authorized by the factories department?

Dear Bapi,

I hope the provisions made under Rajasthan Factories Rules are the same as those of Maharashtra Factories Rules.

The Stability Certificate focuses on Structural Stability.

I have reproduced the condition given in Maharashtra Factories Rules to be filled by structural engineers in Form No 1A.

I certify that I have inspected the premises, the plans of which have been approved by the Chief Inspector in his letter number ............... dated ........, and examined the various parts including the foundations with special reference to the machinery, plant, etc.; that have been installed. I am of the opinion that all the works of engineering construction in the premises are structurally sound and that their stability will not be endangered by their use as a Factory/Part of a Factory for the manufacture of ..................... for which the machinery, plant, etc. installed are intended.

My interpretation of the rule is that any structure above ground needs to have a Stability Certificate when a manufacturing process is being carried out.

To me, the Stability Certificate is not necessary for landfill sites. You can submit drawings only for the structures above ground and take a Stability Certificate.

  • Yes, Stability Structural certificate is required from the Registered Structural Engineer, who is having a degree in the Structural Engineering and competent enough to give the certificate.

  • Dear Bapi,

    According to me, the compound walls and underground water storage tanks do not require stability certificates. The Factories Inspector has not insisted on the same in our case. However, if the water storage tank is overhead, it requires a structure for which a Stability Certificate is a must.

    I am very confused about the structural stability for Madhya Pradesh. Can anyone justify whether the renewal period of a structure is five years, three years, or its lifetime? Sir, please also specify the rule or section of the Madhya Pradesh Factory Act/Rules.
