Can you give me a suggestion on my query? I have worked with ONGC Ltd. for 14 years and 7 months. However, to date, management has not settled my gratuity perks. What should I do? I resigned from the services of ONGC on 17th October 2005. I had taken a House Building Advance in 2002. The remaining outstanding amount due to me is Rs. 4,00,000. I informed management to make adjustments from my PF accounts and other perks and deduct their outstanding due to me. Unfortunately, they filed a writ petition in the civil court. What should be my course of action? Please clarify.

As you are aware, the PF account cannot be claimed by the company. Therefore, unless you settle your account with your pending dues, how can the gratuity be released by the company? They can forfeit the gratuity on charges of fraud.
It is advisable to clear your dues and then proceed with the gratuity claim; otherwise, you may face legal action in court.
