I have one doubt. If I have taken a factory license and start our factory with 200 to 250 contract laborers, is a labor license or employer registration license required for engaging the contract labor? May you please give me some suggestions?

You have to fill Form I and obtain Form II as per CL(R&A) Act 1970. Then only you can engage any contract labor through some contractors. Along with the application, you must provide a list of contractors whom you are going to engage in your factory for carrying out the job.

After obtaining the Registration Certificate for engaging contract workmen, you can issue Form V to your contractors so that they can apply for a Labor License, as advised by Mr. Jaynarayan Modi.

You have not specified what you want to know about notice pay. However, as far as any law on the subject is concerned, the rules pertaining to notice pay are contained in model standing orders framed under the Industrial Employment (Standing Orders) Act, 1946, but not under the Factories Act. If your establishment is covered by the said Act, please verify the certified standing orders of your company insofar as the workmen are concerned. For those employees other than workmen, the Company service rules shall provide for it, or in the absence of such rules, the letter of appointment shall often contain a stipulation. To answer a direct question, yes, you need registration, and all your contractors need a license if they have more than 19 workers employed by them on contracts. However, you may get into trouble trying to do all work through contract labor. You can only use contract labor for non-core and non-perennial work. You should not be using them for production-related work.

Are you going to employ any permanent workforce or run the entire operation with contractual labor? Is it a job contract or a contract of service? In any case, you need to enter into an agreement on stamp paper in the proper format, covering all possibilities and the scope of work with the contractor. You will have to register under the Contract Labor Act, and the contractor will need to obtain a license. All labor laws must be followed by the contractor, and your representative will have to be present during the wage disbursement and endorse the record.
