I have completed 5 years in the current organization and am continuing in the same. Since I have completed 5 years of service, is it possible to withdraw the gratuity amount while still in the same company/service and continue with the same organization?

When I asked my HR, they said, "as per the government order, you will receive the gratuity amount only when you leave the organization" - is this true? I need some money urgently, so I am planning to withdraw my gratuity. If it's possible, I would like to take my 5 years' gratuity amount and continue in the same organization. Then, later, after 2 years, if I decide to leave the organization, will I receive the remaining 2 years' gratuity amount? Please reply and help me as soon as possible.

No, you can't. Gratuity is the benefit you receive when leaving the company, which the management will pay along with your final settlement. There is no provision for receiving gratuity during your service.

Dear Manucse, Its true as above , you can’t apply for gratuity until you are in company and if you have any urgent means you can apply for PF loan. Consult your HR, they will guide u.

Dear Manucse,

Regarding your query on Gratuity, you are not permitted to receive the benefit under Gratuity during the course of employment after completion of the eligibility criteria. Gratuity is payable after completing 5 years of continuous service at the time of leaving the company, based on grounds such as resignation, retirement, reaching the age of superannuation, or a contract between the employee and employer for a specific period, under Section 4 of the PG Act - 1971 Rules.

Gratuity is not your contribution in any way. It is the liability of the employer as per the law, and they have to pay it when an employee leaves the company as a means to express their gratitude for your services for a long period of time. You have no right to claim it as per your need. In case you need funds, you can withdraw an amount from your Provident Fund accumulation or take a loan from PF.
