Hi, I have resigned from my job and have spent five years and two months in that company. Am I eligible for the gratuity? Also, I have filled out Form I of gratuity and submitted it to the company one month ago. They are saying that they will provide the gratuity in December. Would this be valid, or are they trying to delay? What should I do here? Also, how is the gratuity calculated, i.e., based on the last basic salary drawn or the basic salary of the individual year? Please help.

Yes, you are entitled for Gratuity. You can ask the company HR i some papers are to be filled or they will just pay after a period of time. Girraj sharma

Last Basic drawn and you will get the Gratuity. May be the HR dept wants to process your Gratuity with LIC and that too , it will not take time upto December. Follow up with your HR dept

You are eligible to withdraw your gratuity. You have completed 5.2 years of service. Last month, your basic salary was calculated as follows: basic salary * 15/26 * 62 (12 * 5 = 60), representing five years of service. You can contact your HR department regarding this matter.

Please mention your number of years of service also to calculate. You can do it yourself as well. Just add the number of years in place of X below:
34550 * 15 * X / 26 = answer. The maximum gratuity amount is limited to an amount of Rs 3.5 lakh.

Hi, Max Gratuity Limit for the person who retires/resigns before 2010 is 3.5 lac. The ammendment made only after 2010 and increased the limit to 10 lac. Regards Harsha Shetty
