Dear Seniors, Could you please explain what are the benefits which the employee is entitle if the " Disciplinary Authority " imposes the punishment of " Compulsory Retitement?

Dear Friend,
Compulsory Retirement is one kind of punishment in which the employer wants to send out the employee from his firm for one or the other reason. In such a case, the employee who is to undergo compulsory retirement shall entitle to get his salary due for that month, gratuity if he completes 5 yrs continuous service, encashment of earned leave, incentive due if any etc. The bonus will be paid on par with the employees of the organization for the employees who left the services of organization on account of resignation, retirement or termination etc.

Thanks for your prompt reply.
My question is
1)if he has not completed 05 years then does he entitle to claim gratuity?
2) If he has not completed 10 years of service then does he entitle to claim Pension?

Dear Prashant,
Gratuity Act says that a employee should complete 5 or more years for gratuity claiming.
so if an employee completes 5 or more years then he is entitled for Gratuity as per Gratuity act.
