Can some one tell me if it is mandatory to maintain seperate registers - form 12 under Inter-state migrant labour act and Contract labour regulation and abolition act.

If I as a Principal Employer have appointed a contractor working in my end line packaging operation for quite a long time(say 5 years or above) and in his payroll he appoints workmen from another state who are also working for same number of years as contract workmen under the agency, are they termed as migrant workmen.
In short how is a migrant work men defined. Does he have to be recruited in another state or he being from one state but migrated to another where he has been recruited would also classify him as migrant labour.
eg. I am having a factory in Tamil Nadu. Can I consider a contract workmen who has entered and produced valid id of his permanent address in which shows he's a resident of Andhra Pradesh but was recruited in Tamil Nadu. Is he a migrant labour ? or to have him as a migrant labour he should have been recruited in Andhra Pradesh and then brought to Tamil Nadu for work.
