I need to discuss a case with you regarding appointment letter..
There is a person who joins a foreign company.. however it does not have existence in India.. so he is in the payroll of an Indian company which is owned by his boss (Indian).. He is given an appointment/confirmation letter with the name of the indian company.. Now the foreign company is coming into establishment in the month of july.. My question is Can he be given an appointment letter in the following format..' Mr._________ is appointed as ________ in ____________(Foreign company's name) which was formerly known as _____________(Indian Company's name)'... What does the law say??

No the scenario is not too complicated.. :)
Coming to the solution now, I have a query for you...
Is this just the name change of company??? or they are two different establishments? If its the name change only then Yes, you can provide an appointment letter stating the same as you have mentioned.
If it is not just a name change of the firm, then you have to ask him to resign from the Indian company and issue a fresh appointment letter from the foreign company.

wont this effect the person's resume. If in future he looks for change & applies for job chances his resume will not be shortlisted on the following ground .
Why he has changed the job ( job hobber). Practically during screening of resumes how many HR's do check these valid points.
Is it not possible , instead of resignation a new appointment letter is issues to him mentioning company transfer. If inter departmental transfer is possible cant this be followed too.

No he wont be called as a job hopper as this information can be mentioned in the relieving letter that both the companies belong to same person or group.
When Ranbaxy sold one of the subsidiary to the parent company In Germany, similar practice was followed and they did mention everything in the experience or relieving letter.
So dont worry it wont affect negatively in your CV...
