Well, this is Shivani again on the HR forum. I want to ask everyone why I visit this site every day to see comments on my discussion, but I find no one here is interested in giving an answer. Why is that? Please, at least, reply to this question. I need your advice at every step that could affect my career growth.

Dear All,

I want to inform you that I am the HR of the company. Our employees seem to have no fear of termination. So, what should I do in this case? This is a very serious issue. Employees are leaving the company without giving any notice, even though they have already signed the bond. There are other problems as well; they are taking numerous short leaves, not coming in proper attire, and so on. Therefore, I am seeking advice on how to address these issues.

Your question is not clear, Shivani.

May I interpret your question as shown below:
Company (Consultant) providing free training and placement to the candidates and the charges will be borne by the deploying company.

In this matter, you can take guidance from your respective state Training Directorate. I am providing the following link in which you can find the address and contact details of the concerned state training directorate: [State Training Directorates](http://dget.nic.in/asp/strgdir.htm).

Normally, if you select the candidate for free training and placement, the response from the candidates will be very poor. You must charge some fee for that, and for those who are really talented and poor, you can declare a scholarship covering 100% of the expenditure incurred by them for their training (%age may vary from candidate to candidate as per their/your criteria).

For those appointed as Management Trainees/Engineering Trainees, the Government pays some stipend to the company engaging them and to the trainee as well.

Please confirm with the appropriate authority and make use of the same.

Normally, the placement agency will not charge any money from any candidate; they will only charge the company hiring them.

I am also in doubt and unclear about the procedure. After you get clarity, you can inform the same to all our members too.

What does your company's discipline policy say? The HR has to take appropriate action against the defaulters who do not follow the policies, rules, and regulations. For the first time, you can give a verbal warning and provide proper instructions to the erring employee. Furthermore, you can provide a copy of the company policy for them to read and display it in places where all employees can take notice.

On the second offense, administrative action can be taken against the employee. If the issue persists, a show-cause notice can be issued, and appropriate action can be taken as deemed fit. If the employee continues to disregard the rules and regulations of the company, there is the option of utilizing the Annual Appraisal to align employees.

First of all, Shivani, I would like to tell you one thing here. As you said you are the only available HR person in your company, have you discussed the matter with your management? If so, you have to maintain good rapport with your colleagues and locals. Have you ever thought of organizing a weekend picnic with all the staff members and their families? This picnic or weekend outing will bring about some changes in the attitude of the staff.

If your staff are not afraid of termination, it means there is no proper motivation available for the staff. So, mainly, you have to discuss this point with your management and explain it with full document support and attrition rate details. Make some attractive pay packages, staff welfare measures, benefits, and other details in consultation with your management, and announce the same to all the staff members.

You can even announce the Long Service Reward to the existing staff members too.

While giving promotions and during the yearly appraisal time, you can renew the agreement with all the staff members, which will help the staff understand the policy for resignation, notice period, agreement in existence, leave policy, employee benefit details, etc.

You can formulate a dress code for your company that should suit everyone in the company. You can even create cadre-wise dress codes for males and females. Please ensure that your dress code does not spoil the image of your company. It should match the climatic conditions of the area where your company is located, and it should be comfortable attire for all members too.

Dear Shivani,

I am expressing my inability in this regard. I am from the construction industry and I am not aware of IT company requirements. But in general, you can create forms and formats as per your needs. This may include Leave Application, Leave Register, Attendance Register (either in paper or electronic format), PF details, ESI details (if applicable), Tax Details, Registration of your establishment, License, all staff personal files (Offer letter, Interview and selection details, appointment letter, salary fixation and revision details, promotion details, appraisal details, LTA details, family details, etc.).

In two to three minutes, I can think of this much. You can also create your own forms and formats and proceed further, dear. Never start with so much tension. First, have peace of mind and be positive. You must have faith in yourself and believe that you can create your HR Department as per your and management's requirements. All the best.

First and foremost, please take this feedback/suggestions in the right perspective - they are more to do with your generic nature than these specific queries.

1. Please don't get confused and confuse others - you seem to have the habit of mixing up issues.

2. When you are thinking of one issue - to form a solution or just plain evaluating - please don't let other issues (however tough or important they may be - in which case, change your priorities) affect the present. If you do, you would only end up making a wrong decision and/or missing out on those aspects of the case that could have an important bearing on the solution to the issue at hand.

3. Please take ALL THE FEEDBACK and SUGGESTIONS the members of this Forum give ONLY AS INPUTS - you need to evaluate each of them vis-a-vis your situation/problem and ONLY THEN take the appropriate decision. The Forum members are only trying to help you with THEIR experience - NOT with your experience. Please note that no two situations are identical - they may be alike/similar, but never identical.

Coming to your queries, let me FIRST use a brush to put your queries in a clear perspective and summarize your queries - for my own sake of answering them and also for yours and others' sake.

1. How to hire lots of freshers for the IT company.

MY ANSWER: S. Bhaskar has already given you the reply/inputs. If you have any specific queries regarding his suggestions, please mention them clearly so that you can get the right answer, rather than a general statement - if you want the right answer, you have to ask the right question.

2. If the company is providing training cum placement/job to the candidates and not charging anything from the candidates for the training. So, in this case, do consultants provide the candidates to the company or not?

MY ANSWER: What's your EXACT query? Are you referring to some consultants charging freshers or the company charging, or is it that the company DOESN'T want to pay any fees to the consultant - and if so, how to handle the situation? The situation you mentioned, except for the training part - isn't it the same when you hire experienced people too? In such a case, don't you pay the consultants their fees? And mind you, you are giving the freshers training FOR YOUR BENEFIT ALSO - so it's a WIN-WIN situation for both parties involved. I don't quite agree with S. Bhaskar on this - that candidates who don't pay any charges/fees will be of poor quality.

Normally, consultants are expected to take their fees ONLY from the companies/clients - NOT from the candidates (though there are consultants who charge, but that's a different point). Please note that the relationship between the company/candidates vis-a-vis company/consultant is quite different - the former is more of a professional nature while the latter is purely commercial. So if you want consultant services, you need to pay them - right?

3. I want to know what HR does when employees of the company don't follow the company policies, rules, and regulations.

MY ANSWER: First and foremost, please check out your company policies - maybe they are too stringent/impractical (this is quite possible, since many HR persons who are alone in the company just do a 'copy and paste' job from some other company's policies while drafting their own policies). Also, please note that this isn't just ONLY your effort/involvement - the management will have to get involved at a deeper level too.

Sometimes it also pays to involve the senior employees in the drafting process, since they will have control over others reporting to them and thus can help enforce the policies laid out.

There's also another way of looking at this point: I am not sure if you are married. If not, just ask your parents what they did when you didn't listen to them. First and foremost, the acceptance that BOTH are transparent and fair to each other is a must in any such situation - the same applies here.

4. Employees are leaving the company without giving any notice. Even though they already signed the bond. They are taking so many short leaves, don't come in proper dress, and so on.

MY ANSWER: By and large, the same reply as for [4] above. One additional aspect that arises here will be - what are the senior staff doing and what are they saying about such behavior of the juniors? If you are facing the same attitude from the seniors too, then I think there's some serious problem with the overall culture of the company. First, focus on the seniors, in such a case, then the rest will follow - 'yatha raja, thatha praja' goes the saying in Sanskrit.

Regarding the dress, I am not sure what you mean by 'proper dress' - since in IT companies, an informal dress code is pretty much accepted now.

5. Send me all the forms related to HR. Which will help me create new rules in our company (IT company).

MY ANSWER: First, use the Research facility in CiteHR - then use them as the first-cut reference material to formulate your policies. Please note that the word you used is 'rules', which gives a different connotation. Without realizing, you are conveying an impression that you are ABOVE the others - for all you know, you may have conveyed the same impression within the company too. Some employees just don't follow the policies due to such issues from the company/HR - NOT because they think they are right.
