I suppose your co. must be paying for maternity leave just check and tell me how they pays it i mean they credit our salary on monthly basis in that period or after completion of maternity leave of 3mths

hi,
Payment for maternity leave can be made differently under two conditions.
1) Condition 1 if an employee is covered under ESIC
in this scenario, organization will grant the leave, and appropriate government will make the payment during the maternity leave. the payment is made after submission of Form 23 (After chield birth), govt. will pay in 30 days from the submission of form not 23.
2) condition 2 if an employeee is not covered under ESIC.
in this scenario, organization will grant the leave for maternity as per act, and payment of salary can be made on the resumption of duty by an employee.

Payment of Maternity benefit is payable during the benefit period only and not after the resumption of duties. It is the benefit extended during the member is on leave on account of maternity.The intention of the legislation is that the employee should not put to hardship financilly during this period.
In my view and to the best of my knowledge their is no such provision that the maternity benefit is payable after the employee resumption of duties.
If any such provision under the act kindly enlighten me

you should contact your local ESIC office to know more.. we had 5 employees who are currently on Maternity leave, and the procedure, i stated above, was in line with govt. officials....

When a employee proceesds on leave then payment for six-weeks (pre-delievery) is to be made to her before she leaves for availing of maternity leave and rest six weeks payment shall be made within 48 hours of child birth on submission of proof of birth.

This is a new clarifiation on PF. As per the act the contribution for PF is payale only on Basic wages which is as per contract of employment or as per appointment order.The maxium wages for which contribution is payable is for Rs.6500.The minimum basic wages for the purpose of contribution is not fixed.However the department is taking the view that minimum 60-80% of the wage should be basic.Their is not law to this effect.Let me have your views
