I believe your employer will face a problem with inspection from the concerned department if there is not a valid reason for not filing the returns to the concerned department.

Are you deducting the amount from employees' wages? If yes, then it's a 100% penalty because you are utilizing employees' money and the interest on the PF amount. ESI doesn't matter if nobody has claimed it.
Go to the respective offices of each, meet the commissioner, take their advice, and sort out the issues. I hope you understand; otherwise, a 100% penalty means 100% of Rs. 100.00.

Dear Kavitha,
It's nothing to worry about. Just approach the authorities and submit the Reconciliation Statement and the returns. They will charge nominal penal damages and send a notice for not submitting the returns.

Dear Kavitha, I advise you to please submit the returns as soon as possible because, in both cases, the department can go to court against you for non-submission of the returns. In the case of ESI, please submit the return very soon. You will face a major problem at the time of inspection of EPF and ESIC. If you face any problems, you can call me.

Please prepare annual returns for all the years (Form 6, 3A), take a hard copy printout as well as a CD, and meet the commissioner. He will do the needful. Prepare a letter stating the reason for the delay.

Nothing happens if you have paid all the contributions and the ADMH charges. Just go ahead and file the returns now. Most probably, it will cost you a decent lunch and a small gift to the visiting inspector.

There is no provision regarding penalties and interest on the late submission of the EPF Annual Return. However, penalties and interest are imposed if you deposit EPF contributions late. To avoid any inconvenience, you must submit the return timely.
