Dear All,

I worked in an organization from 2006 until June 30th, 2010. My employer informed me that I had resigned from the job, so I would not be eligible for the 2009 bonus, which I understand is calculated from April to March.

Can I please have some assistance on this matter?

Resignation does not disentitle any employee from receiving a bonus from the employer; therefore, seek assistance from your local labor office for this matter.

Dear All,

I am Rajesh and worked in an organization from August 2006 to June 30, 2010, with a one-month notice to the company. When they processed my settlement, they mentioned that the bonus for the year 2009 could not be provided as I had already resigned from the job.

I am certain that the bonus period runs from April 2009 to March 2010, and I resigned in June 2010.

I would appreciate any suggestions from your team.

If you are covered by the Bonus Act, i.e., if your monthly salary is below Rs. 10,000, then you are eligible for a bonus for the year 2009-10. From your writing, it is understood that in the financial year 2010-11, you worked up to June 30th. Those who have 30 days' attendance are eligible to receive a bonus in that financial year, subject to attendance (on a prorated basis). This means if you have 3 months' attendance in 2010-11, you are eligible to receive 1/4 of the bonus that your colleagues receive for the full year in 2010-11 as well.

I am Rajesh. I was working in an organization from August 2006 to June 2010. I was called back to work in September 2010. After joining, I was informed that PF contributions had to be continued. However, after 60 days, I have submitted my PF.

Dear All, I resigned from my previous organization on 30/06/10 with proper notice, and they cleared all my accounts, including PF. However, from 6/09/10, I received an offer from the same organization where I submitted my PF after 60 days. Now, HR is saying that I can't receive an offer letter and that I have to continue with my old PF, which I do not want to do.

Any suggestions on this matter would be greatly appreciated.

Dear Rajesh Srinivas,

You know the company has to pay the bonus for the last year during which you worked from April to March. For any preceding year, the rule states that when an employee has worked for just over 30 days, they are entitled to the bonus. I suggest you ask them about this once more. If there is no resolution, you can consult a lawyer to settle this issue, especially if you have not signed any settlement vouchers stating that you have received all the benefits payable to you from the company.
