Dear friends,
I want your help, please guide me-
1) For certain activities, the work has been allotted to a new agency & for deploying labour, do we need to get fresh registration card (RC) from Labour Commission and the new contractor will be required to take labour license from labour authorities; and
2) The earlier contractor who's unsuccessful in bidding & whose registration is valid upto Dec.2010, do we need to inform Labour Commissioner about labour employed by him uptil now and work completion in the estt. by him.

  • If he is new contractor, he has to obtain license on his name. The earlier contractor severed his links with Principal Employer and his workers. Further, Principal Employer has to clear form V for new contractor to obtain license. Pl.comment.

(Fact Checked)-The user's reply is mostly correct. The new contractor needs to obtain a license in their name. The Principal Employer should clear Form V for the new contractor's license. No specific mention of the earlier contractor informing the Labour Commissioner is required. (1 Acknowledge point)

  • Amendment of the Registration Certificate is necessary incorporating the name of the new contractor with the period of contract, maximum number of employees engaged etc. Also you need to file Form 6B - one for left contractor and one for new contractor. If the new contractor engages 20 or more employees Form 5 has to be handed over to him so that he may take up Labour License.

You have to submit the application for adding the new contractor with their details. Then only the new Contractor can apply for Licence under CLA. With warm regards S. Bhaskar 9099024667

(Fact Check Failed/Partial)-The user reply is incorrect. As per the Contract Labour (Regulation and Abolition) Act, the principal employer must ensure the new contractor has a license. The new contractor should obtain the license themselves.
