Do Charitable trust are covered under Bonus act? Plse explain. This for my client who has been running hospital under charitable trust. Plse explain elaborately Victor

Hospitals come under Shops and Commercial Establishments Act and, therefore, are covered by Payment of Bonus Act and such other Labour enactments like Payment of Wages Act, Minimum Wages Act, Employees provident Fund and Miscellaneous Provisions Act, Maternity Benefit Act, etc.
If charitable institutions are to be exempted from the operation of Labour Laws there can not be found any establishment which is non charitable in paper!

If its cover under any act, and where exceeds 20 or more employees there should implement the bonus act.

I fully agree with Madhu TK.
hOWEVER,
While covering the establishment under Payment of Bonus Act, 1965 the labour department looks for the basic objectives of the Charitable institution. If the objectives are totally for charitable purpoe i.e.no profit-no loss basis,& for the downtroden of the society, you may get exemption from the deptt. This I am telling you out of own experience, where a case was filed by Union against a chariatble hospital under Bonus Act and the manageent won the case only on the basis of "the objectives of the charitable institution"
