Well I am new to this forum with my query and hope I will get the best responses. I just want to know that if a person has a shop in Mahendragarh (Haryana) with over 50 persons working for him on piece rate basis. Is I am liable to register under Shops and Establishment Act. If I don't do that what are the consequences. Can someone also take the benefit of this thing by complaining to the concerned department?
Secondly, as I have told that there are more than 50 persons working in the shop but they are not on regular wages. They are getting for the work done by them. I am paying them at piece rate. Is it mandatory for me to register for ESIC and also I have heard that ESI is not applicable in Mahendragarh (Haryana)

This query is the repetition of your query made on 23.06.2010.
It is made clear that according to The Punjab Shops & Commercial Establishment Act, 1958 as applicable to the State of Haryana we are required to get our establishment (shop & commercial establishment) registered from the area shops Inspector within a span of 30 days under section 13(i) of this Act. If you are confident that you are not doing any manufacturing process / activity as per definition given in Factories Act, 1948 then you are certainly liable to get the Registration under this Act. If you do not do that the area Shop Inspector or any other officer declared as inspecting authority may prosecute you for this violation.
As per my information also this area is not covered under ESI Act.
