A few questions here, which I wish to be replied to:
1. When will the Gratuity Act (Amendment) 2010, as approved by the Cabinet, take effect?
2. Will the employees under the states and the state-owned PSUs benefit from this proposed amendment of raising the cap from 3.5 lakhs to 10 lakhs? (Do the states need separate legislations on this line?)
3. What is the extent of retrospective effect?
4. Here is an employee who retired on 31-03-2010 afternoon and who has been paid according to the rules of payment of gratuity as existed on my date of retirement. Can I make a claim for the balance amount depending on the retrospective application, as and when the amendment comes into force?

1) The act came into effect on 24th May 2010.

2) The amendment regarding the increase in ceiling to Rs. 10.00 lakhs for State Government employees and PSU is already in force.

3) As mentioned above, the effective date is 24th May 2010.

4) In this case, no additional payment is required to be made.
