Dear Mr. R.N. Khola,

The Gratuity Amendment Notification 2010 has two dimensions. One was to enhance the limit for the private sector from Rs. 3,50,000 to Rs. 10,00,000; the second was to amend the income tax limit for employees from PSU and other sectors, similar to what was done for central government employees, to enhance the limit from Rs. 3.50 lakhs to 10 lakhs and its effective date. Please clarify the second point if there is any information.

Hi,

I have completed 4 years and 9 months in the company, but my company is not giving me the gratuity. Could anyone suggest what I can do? Also, please email me the judgment of the Supreme Court that states that an employee is eligible for gratuity after 4 years and 8 months.

Welcome to CiteHR. Approach the office of your area Labour Inspector and file a complaint before him for the settlement of your remaining dues. If the matter could not be settled at his level, then file a claim case before the Controlling Authority under The Payment of Gratuity Act, 1972 for the difference in gratuity. In Haryana, Labour Officer-Cum-Conciliation Officers are declared as the Controlling Authority under this Act.

Hi all,

I have one problem here, i.e., I worked for a period of 4 years in a company named A and transferred to another company named B. These two companies have the same directors and the same management. Now, I have resigned from company B after 2 years of service. Am I eligible for gratuity? If so, where do I have to claim it - from company A or B?

One employee worked in a company named "A" for a period of 4 years and was transferred to a company named "B" (These two companies come under the same management; the directors and managing director are the same). There he worked for 2 years and resigned. Is he eligible for gratuity? If so, from which company has to pay his gratuity and which salary has to be considered to calculate the gratuity. Please help me.
