Provisions relating to encashment of Earned Leaves are provided in State Shops & Commercial Establishment & The Factories Act, 1948 & therefore first see which of the Act is applicable to your establishment & then go through this provision in that particular Act for your query.

How do we calculate the earn leave eligibility? Is it for 1 day on each completed working of 20 days? For the purpose of this calculation can we take the paid holidays into a/c?

Dear Ramachandran,
In my opinion if an employee is entitled to receive encashment of earned leaves standing to his credit in accordance with any of the enactment then gross salary is to be consider.You must have seen that one can accumulate certain no of earned leaves as prescribed under applicable law to the unit.
If the no of leaves are more than the limit then it is the discretion of the employer whether to encash or not this no of over & above leaves. If none of the Act is applicable then we are to abide by the service rules of the unit.
