I have just joined a startup company in Delhi and am responsible for building the HR department and policies from scratch. Please help me on the following topics:

1) Is it necessary to have paid leaves? I mean, is it necessary to encash leaves for people who leave our organization.
2) What is the ideal breakdown of different types of leaves?

Dear Colleagues,

Briefly and quickly, I would like to list the types of Corporate Leave Periods that an employee could seek, depending on certain principles—e.g., length of stay on the job, confirmation of marital status, urgency of need to take such days, medical confirmation of illness, approval of study period, etc.

1. Casual Leave: This is a leave period that virtually all categories of employees are entitled to, ranging between 1 day and 5 days. Most times, it is for unexpected personal assignments.

2. Sick Leave: This is usually ascertained or approved by a medical practitioner. When an employee visits the hospital and the doctor recommends a period of rest, this document is forwarded to the HR Department for necessary actions, such as visitation, etc.

3. Annual Leave: This is almost a statutory requirement for employers to provide to their employees. It comes with an allowance/grant based on a particular payment plan—usually 10% of the annual basic salary, etc.

4. Maternity/Paternity Leave: This leave is typically granted to employees who have just delivered a child. In most cultures, it is the mother who benefits from this leave period, spanning 3 to 6 months. Recently, fathers have also started benefitting with a few days off, typically 2 to 4 weeks.

5. Study Leave: This type of leave is granted to employees who have been admitted to a particular educational program that requires them to be on campus or within learning centers. They seek time off from the office to undertake their educational assignments, which could last for 1 or 2 years, depending on the course duration.

6. Sabbatical Leave: This leave is often provided to personnel in educational environments to allow them time to engage in educational activities at a school/university of their choice. It usually lasts for 1 year, and many lecturers opt for this opportunity.

7. Leave of Absence: This leave period is granted to an employee who needs time off to attend to personal matters that could be too burdensome if combined with their current employment, such as political appointments or governmental assignments.

8. Off Duty: This type of leave is typically given to employees who work on a shift basis, including security personnel, nurses, medical practitioners, customer service representatives, firefighters, oil and gas personnel, etc.

It should be noted that depending on the internal operations of the firm concerned, some of these leave periods may not have financial obligations attached to them, e.g., Leave of Absence.

It is necessary to pay leave encashment at the time of leaving for paid leave in credit of any employee if he is eligible for the same as per the act and rules.
