With regret, we hereby inform you that your employment with us stands terminated with effect from the closing business hours today, i.e., [insert date].

You have violated/breached the following terms and conditions of the letter of appointment/service agreement, i.e., Long Absenteeism without permission, forcing us to invoke the right vested with us under clause 9 and resulting in termination with immediate effect.

Furthermore, a thorough audit will be conducted regarding the sites acquired by you to our satisfaction. In the event of any further breach of trust/misrepresentation/illegal gratification/unjust enrichment/misappropriation being noticed, appropriate steps shall be taken by us against you to recover the same.

Additionally, we reserve the right to take appropriate action against you for any act or omission committed by you during the period of your employment with us that comes to our knowledge at a later point in time. In the event of any claims being raised by any person against you, you shall be responsible and liable to settle such claims at your own cost and efforts without reference to this termination.

Directly, you cannot terminate for unauthorized absenteeism; there is a process for termination. The first step is a charge sheet, followed by an inquiry into the facts of absenteeism. Finally, if "unauthorized absenteeism" is proven during the inquiry, only then can you terminate.

You have been consistently absent from work, and upon reviewing your attendance record, it has been found that your attendance has been highly irregular. You have been continuously absent since ______ to the present date without prior leave approval. This unauthorized absence for more than ten consecutive days is reflected in your attendance record for the period from February _____ to November _____ as detailed below:

Your absence has significantly disrupted the work schedules in your department. The unauthorized absence mentioned above, if proven on your part, constitutes misconduct as per clauses 20(f) and (k) of the Model Standing Orders under the provisions of the A.P. Industrial Employment (Standing Orders) Rules 1953, which are applicable to our company. The relevant clauses state:

20(f) habitual absence without leave, or absence without leave for more than ten consecutive days

20(k) ...commission of any act subversive of discipline

Therefore, you are directed to show cause within 48 hours from the receipt of this charge sheet as to why disciplinary action should not be taken against you. If you fail to provide your explanation within the stipulated time, it will be deemed that you admit the charges and have no explanation to offer. In such a case, appropriate disciplinary action will be initiated against you in accordance with the law.
