Hellow any one can help me wether i am eligiable for gratuty claim?
Hi i am worked in on organisation for the period from dt may 2000 to July 2006 in several designations. in that organisation i wont get any gratuti benfit from that organisation ofter resignation. whare i gat the information abt gratuty i went ther (that offiec) i contract with the concern depot head regarding that. he replaied that when you joined that time we are not made any provision for that gratuty, so you are unable to get the benfits of gratuty . is iam eligible that gratuty? please suggest me , if eligible how can i claim that? ofter resignation in what period will be applicable? please suggest me please

Since you have put in more than five years of service with the establishment you are eligible to get gratuity. It is immaterial whether the employer had provided for the payment of gratuity or not. Provision for gratuity is their obligation only.
In order to get gratuity, please apply in Form I. If you go to the search tool typing "Gratuity forms" , you can get form I.

i went there and asked for Gratuty they told we are unable .
for thet how can i proseed , whom to complain ? and how? ofter resigning that organisation (march 2006) a large time scrolled, please suggest me sir

You may apply for gratuity in form I with a covering letter. If you do not get gratuity you can raise it before the District Labour Officer who is the appropriate authority for Payment of Gratuity Act.
