One thing you are missing here anyting more than 8 month's (240 days) will be deemed as a year for Gratuity payment purpose, so Vijay, in your case you are eligible for the payment of Gratuity.

I agree to Mr. malik. Gratuity is applicable after employee completes 05 Years of Continous services.
1) If employee completes 05 Years 6 Months, Then he is entittled for 06 Years Gratuity.
2) If Employee completes 4 Years 10 Months, then employee is not entittled for gratuity as he is not completing 05 Years of Service.

Hi, For becoming eligible for gratuity payment, you must have served 4 years 240 days. In between no salary deduction had been made on account of leave without pay. Regards,

5 years continuous service is mandatory and if a person completed 5 years continuous service and thereafter more than six months service shall be treated as one full year.
For example : 5 years & 7 months =6 years
5 years & 5 months= 5 years
5 years & 6 months= 6 years
4 years & 11 months & 29 days =not eligible.

I agreed with Mr. Malik,it is clearly written that elgibility only after completion of 5 years of continuos job in the same organisation.
After completion of 5 years there may be consideration of 6 months into one year,but 5 years has to be completed.
