Our organisation employees wanted to withdraw entire PF amt including the FPF amt. but they are going to complete their 10yrs service. My Querry is ;
a) Can employee withdraw his entire PF amt while working in same organisation with new PF number, without any break?
b) if not, then under what clause/section it is mentioned ?
c) We have aware them benefits of FPS & also offer them for advance under form no.31 but still they did'nt want to continue their contribution with Employee pension fund? How to cope up with this situation ?

Hi Katri,
I think this is not possible. You can not take new PF number for the same employee who is holding already. If you want to close his current PF number then that employee has to resign.
Upto my knowledge no one can withdraw PF amount while on service.
I am not sure about this idea but still i wanted to share with you
If your company policies permit employee can resign and rejoin your concern again in the next month. So this way employee will get new PF number and you can close his old one.

almost rajasekar has replied your query but little more i want to clear it.
an employee can not withdraw his PF till he is in service.you can not allot anonther PF code without break in service.you can not do as mentioned by rajesh,resign and rejoin in next month.dear if someone resigns and rejoin before withdrawl of PF contribution than you should deposit PF on same account number.what is form 11 you are taking from employee at the tiome of joining ,it is declaration which individual gives that he was not a member of PF in previous organation.
there is only one solution they have to resign and take full and final and withdraw PF.
than if you wish u can take them back.

As mentioned above, 'the employee cannot withdraw his PF benefits when he is in service' is there any supporting written law in PF act?

Hi,
My Dad is a State government employee. He is still in service but he withdrew his PF for my wedding.
Just wanted to quote that PF can be withdrawn being on service but only for a certain reasons specified by the law.

Dear Vineet Saini, Please note your Father must be PF member for about 7 years due to which he was able to apply for Advance. He has got Advance on his PF contribution for some reason which may be for your sisters marriage/ your marriage/Medical expenses / renovation of your home/ purchase of plot / purchase of ftat etc. No one can withdraw his or her PF dues without resignation from the Firm or company please note.
