This is a very imp section in our constitution and all educated voters must know.

Section 49-O of the Constitution

Do you know that there is a system in our constitution, as per the 1969 act, in section "49-O" that a person can go to the polling booth,

confirm his identity, get his finger marked and convey the presiding election officer that he doesn't want to vote anyone!

Yes such a feature is available, but obviously these seemingly notorious leaders have never disclosed it. This is called "49-O".

Why should you go and say "I VOTE NOBODY"... because, in a ward, if a candidate wins, say by 123 votes, and that particular ward has

received "49-O" votes more than 123, then that polling will be cancelled and will have to be re-polled. Not only that, but the candidature of the contestants will be removed andthey cannot contest the re-polling, since people had already expressed their decision on them.

This would bring fear into parties and hence look for genuine candidates for their parties for election. This would change the way, of our whole political system... it is seemingly surprising why the election commission has not revealed such a feature to the public....

Please spread this news to as many as you know... Seems to be a wonderful weapon against corrupt parties in India... show your power, expressing your desire not to vote for anybody, is even more powerful than voting... so don't miss your chance.

So either vote, or vote not to vote (vote 49-O) and pass this info on...

"Please forward this mail to as many as possible, so that we, the people of India, can really use this power to save our nation"

Use your voting right for a better INDIA.

There are several strands on this and it appears that the reference is to 1961 and not 1969.

Vikaskaul has this to say in his May 2006 blog:

Conduct of Electoral Rules, 1961. Section 49-O.

I recently came across a post on a blog hailing 49-O as, if I may, the final solution to get back at Politicians because of their treachery and backstabbing millions of Indians. In the first cursory look, it sounds like a very attractive idea! But, is it really?

Now, there are two types of solutions: Short-term or Long-term. My immediate opinion was -

"Terrible move!!(in the short run). Don't even think of this."

Some commentor(?) asked me - "Vikas can you please explain me why you describe this a terrible move???"

I should have given my reasoning right there; but I don't know why I didn't. Anyway, I thought I should do some research on 49-O before presenting my rationale.

Unless the Supreme Court of India (SCI) has given it a green signal in the last month, which I doubt, 49-O in it's new avatar hasn't been included in the Conduct of Electoral Rules yet. The decision on the same is pending before the SCI.

Petitioner = People's Union For Civil Liberties, 2004(?). Here you can search for the status of the case. I tried, but the site is excrutiatingly slow!! I even tried to search on PUCL's homepage, but couldn't find anything. Weird!

Now that is a great idea, and I hope that particular part of the constitution cannot be amended in any way. I think that I may use that particular optio come this general elections, for all the parties are equally bad, ranging from comparing a martyar's family to that of a dog to the other taking around film directors to the taj with an eye on making money out of other people's misery.
