Our Industry come under Bombay Shops & establishment Act
I have draft leave policy where
PL- 21 days CL- 3 days & SL- 3 days, upto 48 leaves can be carried forward and maximum of 10 leaves can be encashed in a year. These said leave policy is from calender year 1st April 2009-31st March 2010.
This is the first time we have draft Leave policy for our company prior to that we used to give 27 days leave in a year ( CL, SL, PL was not merged ,
Now we have employees working in our organisation for last many years whose leaves had been accumulated for more than 50 to 60 days.
If we implement the said leave policy, can we lapse their accumulated leaves for more than 48 days or we have to compensate their total accumulated leaves ( leave enchashment)
Can we all of the sudden inform the employees that their leaves more than 48 had been lapsed.
Is is legal to lapse the accumulated leaves.

HI Parab,
EL has to be enchashed....Earned Leave can be accumulated upto a max.60days Beyond 60 Days, the leave will be elapsed however the member can encashe it by keeping a minimum of 30 Days balance to his/her credit.However, encashment will be permissible only for minimum of 5days or more..Latest Basic Salary while encashment.

Kindly correct me whether PL can be accumulated upto 42 days as per Bombay Shops & establishment Act beyond which the leaves will be lapsed.

i agree with bharadwaj.
only 60 PL/EL can me accumulated, other than that all extra el will be lapsed.
CL always lapse at the end of every year.
SL can be carried forward but cannot be encashed at all.
leave year always starts with calender year and not with financial year.
kindly check these points and give me the feedback if i m wrong.

I agree with bharadwaj.
EL/PL can be accumulated upto 60, all extra will get lapsed
CL cannot be carried forward to the next year nor enchased.
SL can be carried forward but cannot be enchased.
leaves always starts with calender year i.e. from 1st january and not from financial year i.e. 1st april
and finally, if u announce to the employees now that their leaves are going to be lapsed, then there will be chaos.
you have to intimate prior atleast 6 months that if the leaves are more then the said leaves, then the extra leaves will be lapsed
