My salary is 9500/- from April 2007 to December 2007. It is increased to 10,100/- from January 2008 onwards. Am I eligible to receive bonus for the months from April 2007 - December 2007.
If an employee has worked for less than 10,000 Rupees for even one month in an financial year and for the rest of the months he has drawn a salary of more than 10,000/- then Is the person entitled for that particular month bonus for which his salary is less than 10,000/-

Thank you for reply Mr. Malikjs. MY company HR is saying that since my salary was above 10,000/- on the date of calculation of the bonus I am not entitled to receive it even though i had salary below 10,000/- for 10 months. Can you please tell me where can i find an exact rule which states that I am entitled to receive bonus. Can you plese tell me how it is 3500/- only.

your HR is not correct .pls refer section 8 of payment of bonus act .if someone work more than 30 days in financial year is entitle for bonus and you were employee 9 months ,so they can not refuse u bonus.
dear eligiblity for bonus is 10000 but it should be paid by considering that u were paid 3500 only.

Firstly, bonus is always calculated on Basic + DA(Dearness Allowance) if these components are less than 10k monthly then your are very well eligible for Bonus for period April 07 - March 08 which has to be paid before 30th Sep 08.
If at all your basic + DA component goes above 10K per month from January 08 then you must be paid bonus for the period April 07 - December 07.
Please tell your HR that bonus not payable is legal offence under labour law.

you are entitled for bonus for the financial year and also tell your HR that Bonus is paid for last year not for current year so he cannot tell that you are not entitled.
Bonus is been calculated on Basic+DA

You are very much eligible for last year bonus...now that your basic plus DA exceeds 10000 you will not get bonus but you should get same amount henceforth as EX-GRATIA..
