Hi,I would like to know regarding a particular case in my organisation. My Org is an Software Dev org. Recently we have served notice to an employee giving him 2 months notice for termination. This was because of his poor performance and lack of code of conduct. But after the notice his behaviour has been very frustating. Can we stop the 2 months notice and fire him right now paying him salary till the days he has worked for.Kindly reply by tomorrow. I have to take the call by Monday

Can i know why he has to serve a notice period of 2 months..
If his roles & responsibilty is well understood by some other person or the one whom you have newly recruited.. You can Surely take up a call against him.
This usually happens.. When a person comes to know that his serving days are very few with the existing company.. There will be lack of interest towards his work & he demotivates other Colleagues as well.

Hi Husna,Basically our appointment letter has only one clause that if you want to terminate the job - either side has to serve a notice of 2 months. So while serving termination notice we had to give him 2 months or 2 months equivalent salary. But after serving notice he is behaving very unprofessional manner. In this case can we remove him by paying salary till the day he has worked or we have pay for the complete 2 months.

Hi,
I am also working with one of the softwar company as an Executive HR.
We have same 2 months notice period clause in appointment letter but in case if we came across such case we have provision to let go or reliev that emplyoee before completion of his 2 months but in such case you have to provide him salary of whole 2 months.
Better you consulte with your top management.

If you ask him to leave before the 2 months notice, you will have to pay him the remaining amount for which you didnt give him notice. I think it is very straight forward.

In my opinion there is two options:
1. You can release him on immediate basis to pay 2 months salary for his poor performance.
2. Or ask him for resignation before some counceling as this very better for employee or employer side.
But you can release / fire as per terms and condition agreed with him.
