Hi, Can some one tell me whther minimum wages are applicable to contarct employees / Data Entry Operators etc. posted at Banks in Mumbai

Very strictly speaking, contract workers are to be regarded as our own employees and as such they are also eligible for minimum wages. The applicability of any labour law to a particular situation is judged on the presence of 'employer- employee' relationship. Here, even though work is done by outsourced employee, we have our right to reject the work (done wrongly) which implies that there exists employee- employer relationship between us and the contract worker. In the similar way, he can claim benefits such as minimum wages, ESI, EPF etc. Madhu.T.K

Dear Madhu, Mnay Thanks. Any way we are paying much more. In what schedules employment will they come in Maharashtra . Will they be under 'shop and commercial establishment, not being a banking company'

If there is separate schedule for Banking Companies, list them under it. Otherwise, the firm will come under 'Shops and other Commercial Establishments' Regards, Madhu.T.K

Are Private Banks & PSU Banks comes under State Government or Central Government to pay the Minimum Wages to the Contract Staff ?
PSU/Private Banks and those comes under Shop & Establishments, are they needs be registered under State Labour Commission or Central Labour Commission ?

Though banks would fall under the category of "commercial establishment" as per the State's Shops and Establishments Acts, Public Sector banks would not come under the purview of the S&E Acts because they are Central Govt Undertakings subject to the control of the Reserve Bank of India; but Private Sector Banks would do.
Coming to the issue of payment of salary to contract employees either on FTC or through outsourcing, if such employees are engaged on the same or similar works done by the regular employees of the bank, I think that they should be paid at the same rates applicable to regular employees based on the doctrine of "equal pay for equal work".
