Dear all,
iam ex employe of an organisation , i resigned from duties from 2014 may , since that day company not paid my gratuity ,last few i asked the process about gratuity, they told it will pay through Lic . is this true ,if it is true when i get my gratuity amount appoximately.
my service in my company 7 years 5 months 16 days

Under the prevalent laws of gratuity, no Employer can refuse to pay the gratuity. It is true most of the companies have a group gratuity account with LIC or others. But the buck stops with the employer only. Unless he has filled in & submitted the relevant forms for withdrawal of gratuity, LIC on it own cannot presume these pay outs. Pl. check if they have filed relevant forms with LIC for the pay out of gratuity. Assuming for a moment that they are likely to deny, then you have a remedial course to rise your objections with the Deputy Labour Commissioner - Central & they would immediately act on it & if it is belated, there is also an interest component that will be ordered.
