If the Cooperative society has been engaged in the activity which will come under the scope of "industry" whether for profits or not, will be under legal liability to pay gratuity. If the said 'industry' has been manufacturing some products, or is into plantation or mining activity then the number of employees is not a governing condition for coverage but it would come under the purview of the Payment of Gratuity Act even if there is only one employee. At the same time, if the industry is involved in some trading or commercial activity then it would require minimum of 10 workers for coverage. Yes, those who has been in continuous service of 5 years only would be entitled to get gratuity.

To be eligible for the benefit, by law they must have worked continuously for at least 5 years at the cooperative, except in cases of death or disability, in which case the benefit will be paid even if it is less than 5 years. The benefit will be paid when the employee retires, resigns or is terminated after meeting the service period requirement.
